Mis-sold Mortgages
Mortgage regulations state that mortgages, whether organised via a broker or lender, must be affordable for the entire term of the mortgage. If not, then it is possible that your mortgage could be considered mis-sold and you may be able to claim compensation.
A common case of mis-selling is when buyers were given interest only mortgages and were not fully made aware of the implications and the potential need to switch to a Repayment Mortgage at some point. This type of mortgage would have worked at significantly more expensive in the long term.
This sort of negligent advice from a broker or a lender could have resulted in your mortgage being mis-sold and open the potential to making a claim.
Do any of these apply to you?
- You have a mortgage of £60,000 or over that is ongoing, or that was redeemed not more than 6 years ago
- You have ever fallen into arrears with your mortgage
- You have been charged excessive administration fees or arrears fees
- The lender paid your broker a fee that was added to the mortgage
FAQs
SJS Legal are skilled at dealing with thousands of claims like yours. We assess each claim and its chances of success so that we do not give you false hope of making a successful claim. We will efficiently and honestly have our experts assess your claim, and if you qualify, we will pass you onto one of our dedicated solicitors to deal with the claim on your behalf.
No, making a claim will not have any impact on your current mortgage nor will it affect a future mortgage as it has no impact on your credit rating. Your current lender is obliged to treat your fairly and cannot alter your current mortgage to less favourable terms as a result of you making a claim.
You will not have to pay a thing up front, as we work for you on a No Win, No Fee basis. We will offer you a no obligation consultation, and once we have established the likelihood of a valid claim will ask you to sign terms which mean that all costs will be covered in the event your case is not successful. In the event that your claim is successful, we will deduct a percentage of your compensation, usually up to no more than 30%.
It’s not a big deal if you can’t find any paperwork relating to your mortgage. If you provide us with details of your mortgage provider and when you took the mortgage out, we will be able to get the details from them.
It may still be possible to make a claim even if you no longer own that property for which the mortgage was taken out. It’s possible if you were forced to sell your home or downsize due to being unable to afford it, that your mortgage was mis-sold. There is always a possibility that you might have been overpaying on the mortgage for the time you were at the property.
It will not matter if one party is no longer at the property – both would have the right to make a claim. Even if it would be difficult having to deal with an ex-partner, all we need is a signature from both parties and we can then direct our attention to a designated person making the claim.
Mortgage compensation claims are usually against the mortgage provider or your broker who enabled it. Much will depend on how you obtained your mortgage and the advice you received at the time. If the person or company you are claiming against are no longer in business, it may be possible to make a claim against the Financial Services Compensation Scheme (FSCS).
Mortgage compensation will vary and will depend on the degree to which you have been disadvantaged by the mis-selling or the overpayments. Compensation will consider the financial position you are in now and the position you would have been had you not been mis-sold or overcharged.
